## Overview

China's **Interim Measures for the Management of Recycling and Comprehensive Utilization of Waste Power Batteries of New Energy Vehicles** (the "Measures") were introduced to address the growing volume of waste power batteries generated by the rapid expansion of the new energy vehicle (NEV) market. The Measures establish a legal framework for the safe and efficient recycling of waste batteries, emphasizing traceability, environmental protection, and resource recovery.

The Measures align with China's broader goals of promoting a circular economy and reducing the environmental impact of end-of-life (EOL) batteries. They complement existing regulations, such as the **Extended Producer Responsibility (EPR) system** and the **New Energy Vehicle Industry Development Plan (2021–2035)**.

## Key Requirements

The Measures introduce several core obligations for stakeholders across the NEV battery supply chain:

- **Traceability System**: All power batteries must be registered in the **national traceability platform**, which tracks the lifecycle of batteries from production to recycling. This includes unique identification codes for each battery unit. The system functions in practice as a battery passport-style framework, enabling end-to-end tracking of batteries across the entire value chain.
- **Recycling Responsibilities**:**Battery Producers**: Must design batteries for easy disassembly and recycling, provide recycling instructions, and establish collection systems for waste batteries.**NEV Manufacturers**: Must collaborate with battery producers to ensure traceability and facilitate the return of waste batteries from end-users.**Recycling Enterprises**: Must obtain licenses for recycling activities, adhere to environmental and safety standards, and report recycling data to the traceability platform.
- **Environmental and Safety Standards**: Waste batteries must be stored, transported, and recycled in compliance with national environmental protection and safety regulations. Hazardous materials must be handled and disposed of according to strict protocols.
- **Comprehensive Utilization**: Recycling enterprises are encouraged to prioritize **comprehensive utilization** (e.g., material recovery, repurposing for energy storage) over disposal. The Measures incentivize the development of advanced recycling technologies to maximize resource recovery.

## Compliance Timeline

- **March 1, 2026**: Measures issued by the Ministry of Industry and Information Technology (MIIT).
- **April 1, 2026**: Measures enter into force. All stakeholders must begin compliance with registration, traceability, and reporting requirements.
- **April 1, 2026**: Launch of the **national traceability platform** for waste power batteries. Battery producers and NEV manufacturers must register their products and begin submitting lifecycle data.
- **Ongoing**: Recycling enterprises must obtain licenses and comply with environmental and safety standards. Annual reporting of recycling activities is required.

## Affected Parties

The Measures apply to a broad range of stakeholders in the NEV battery ecosystem:

- **Battery Producers**: Manufacturers of power batteries for NEVs, including lithium-ion, nickel-metal hydride, and other chemistries.
- **NEV Manufacturers**: Companies producing electric vehicles, hybrid vehicles, and plug-in hybrid vehicles.
- **Importers and Sellers**: Entities importing or selling NEVs or power batteries in China.
- **Recycling Enterprises**: Companies engaged in the collection, storage, transportation, and recycling of waste power batteries. These enterprises must be licensed and comply with environmental and safety standards.
- **Operators of NEVs**: Fleet operators and end-users are encouraged to participate in battery recycling programs but are not directly regulated under the Measures.

## Implementation Requirements

The Measures mandate specific actions to ensure compliance:

- **Traceability Platform Registration**: All power batteries must be registered in the national traceability platform, with unique identification codes assigned to each unit. Producers and NEV manufacturers must submit data on battery production, sales, and recycling. The system functions in practice as **a battery passport-style framework**, enabling end-to-end tracking of batteries across the entire value chain.
- **Collection Systems**: Battery producers and NEV manufacturers must establish systems for the collection of waste batteries, either directly or through partnerships with licensed recycling enterprises.
- **Licensing for Recycling Enterprises**: Recycling enterprises must obtain licenses from local authorities, demonstrating compliance with environmental and safety standards. Licenses are subject to periodic review.
- **Data Reporting**: Recycling enterprises must report recycling volumes, methods, and outcomes to the traceability platform. Annual reports are required to verify compliance with recycling targets.
- **Environmental and Safety Compliance**: Waste batteries must be stored, transported, and recycled in facilities that meet national environmental protection and safety standards. Hazardous materials must be handled in accordance with the **Law on the Prevention and Control of Environmental Pollution by Solid Waste**.

## Penalties and Enforcement

Non-compliance with the Measures may result in the following penalties:

- **Fines**: Violations of traceability, recycling, or environmental standards may incur fines ranging from **CNY 10,000 to CNY 500,000** (approximately USD 1,400 to USD 70,000), depending on the severity of the offense.
- **License Revocation**: Recycling enterprises found to be in violation of environmental or safety standards may have their licenses revoked, effectively barring them from operating in the sector.
- **Product Bans**: NEV manufacturers or battery producers that fail to comply with traceability or recycling requirements may face restrictions on the sale of their products in China.
- **Legal Liability**: Serious violations, such as illegal disposal of hazardous materials, may result in criminal liability for responsible individuals or entities.

Enforcement is carried out by the **Ministry of Industry and Information Technology (MIIT)** in coordination with local environmental protection bureaus and industry regulators.
